ALLCABOREALESTATE.COM TERMS OF USE AGREEMENT 

ALLCABOREALESTATE.COM is a website service that allows property owners, real estate and rental agents, hotel/resort managers, and property developers to list and advertise their properties for sale or for rent. Potential buyers and/or renters are then able to view the properties online and directly contact sellers and landlords responsible for those listings which are of interest to them.

The service is owned and operated by MARKETING CABO based in Canada.  By whether or not you register to list and advertise property as a member ("Member"), If you wish to use the service (the "Service"), please read this Agreement first.

This Agreement sets forth the legally binding terms for your use of the Website and the Service.

ALLCABOREALESTATE.COM may modify this Agreement from time to time. Such modification shall immediately become effective at the time ALLCABOREALESTATE.COM posts it on the Website. You agree to be bound by any changes to this Agreement when you use the Service after any such posted modification. This Agreement includes ALLCABOREALESTATE.COM's policy for acceptable use of the Website, your rights, obligations and restrictions regarding your use of the Website and the Service, and content that can be posted on the Website. This Agreement also includes ALLCABOREALESTATE.COM's Privacy Policy.

ALLCABOREALESTATE.COM reserves the right, in its sole discretion, to reject or refuse to accept your membership, or revoke your ability to post content, or to remove any posting by you, or to restrict, suspend, or terminate your access to all or any part of the Website and/or Service at any time, if we find you have violated any of the Website's terms of use, prior to or after becoming a member, with or without prior notice, and without liability.

ALLCABOREALESTATE.COM provides members with online functional tools enabling users, by themselves, to arrange reservations, appointments etc . By participating in any offline activity, you agree to release and hold ALLCABOREALESTATE.COM harmless from any and all losses, damages, rights, claims, and actions of any kind including, without limitation, personal injuries, death, and property damage, either directly or indirectly related to or arising from your participation in any such offline activities.

Terms of Use

1) Eligibility.
The Service is prohibited, wherever local laws, regulations and/or customs do not permit such. By using the Website and the Service, you represent and warrant that all property information you submit is truthful and accurate and that you agree to maintain the accuracy of such information. You further represent and warrant that you are legally allowed in the country or area of the property location to provide the listed property information and publicly communicate such information with potential customers, and that your use of the Website and Service shall not violate any applicable law or regulation. Your profile may be deleted without warning, if it is found that you are misrepresenting your relationship to the property and/or your identity, including the real estate license. Your Membership to list and advertise property is solely for personal use or as a designated representative of your agency or company, and you shall not authorize others to use your account, including your profile and related email address. You are solely responsible for all Content published or displayed through the Website on behalf of your account, including any email messages, and for your interactions with website users.

2) Term/Fees.
This Agreement shall remain in full force and effect while you use the Website, the Service, and/or are a Member. You may terminate your membership at any time. By using the Service and by choosing to become fee based Member, you acknowledge that ALLCABOREALESTATE.COM reserves the right to charge you for your choice of a fee based Service and has the right to terminate your Membership, upon breach of this Agreement, which may include failure to pay for the Service, as required, or any other breach of contract. A Service Fee also occurs when you request an upgrade and/or request the placement of positioned advertising or specialized customer services, for example targeted ad placement or translation services.

3) Commercial Use by Members.
The Website is specified only for the use to place and list property advertisement(s) and may not be used in connection with any other commercial endeavors, unless you are provided prior consent, endorsement and/or approval by the management of ALLCABOREALESTATE.COM . Illegal and/or unauthorized use of the Website, including collecting usernames and/or email addresses of members by electronic or other means, for the purpose of sending unsolicited email or unauthorized framing of or linking to the Website, will be investigated. Commercial advertisements, affiliate links, and other forms of solicitation may be removed from member profiles and advertisement listing(s) without notice and may result in termination of membership privileges. Appropriate legal action will be taken by ALLCABOREALESTATE.COM for any illegal or unauthorized use of the Website.

4) Verification of Real Estate License or Property Ownership.
ALLCABOREALESTATE.COM reserves the right to verify your real estate license, property ownership, or legal documents supporting your right to advertise the property you wish to list on the Website. We may request that you provide us supporting evidence beyond any information that you may have already provided. Failure to provide such information, to our proper satisfactory and verification, could result in the suspension or termination of your membership. We execute a verification process in order to protect our online users.

5) Proprietary Rights to Content on ALLCABOREALESTATE.COM .
ALLCABOREALESTATE.COM owns and retains all proprietary rights to the Website and the Service. The Website contains copyrighted material, trademarks, and other proprietary information of ALLCABOREALESTATE.COM and its licensors. Except for that information which is in the public domain or for which you have been given written permission, you may not copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information.

6) Content Posted on the Site.

a. You understand and agree that ALLCABOREALESTATE.COM may review and delete any content, comment, photos, video or profiles (collectively, "Content") that in the sole judgment of ALLCABOREALESTATE.COM is deemed to violate this Agreement, or which may be offensive or illegal or violate the rights of any member, or harm or threaten the safety of any users.

b. You are solely responsible for the Content that you publish or display (hereinafter, "post") on the Website and/or Service, or any material or information that you transmit to other users.

c. By posting any Content to the Website, you hereby grant to ALLCABOREALESTATE.COM the non-exclusive, fully paid, worldwide license to use, publicly perform and display such Content on the Website. This license will terminate at the time that ALLCABOREALESTATE.COM or you remove such Content from the Website.

d. The following is a partial list of the kind of Content that is illegal or prohibited on the Website. ALLCABOREALESTATE.COM reserves the right to investigate and take appropriate legal action in its sole discretion against anyone who violates this provision, including without limitation, removing the offending communication from the Service and terminating the membership of such violators. Prohibited Content includes Content that:

1) provides and communicates information to potential buyers without legal rights to list the property;
2) promotes information that is false or misleading or promotes illegal activities;
3) promotes an illegal or unauthorized copy of another person's or organization's copyrighted work;
4) involves the transmission of junk mail, chain letters, or unsolicited mass mailing or spamming;
5) solicits passwords or personal identification information for commercial or unlawful purposes from other ALLCABOREALESTATE.COM users.

e. You must use the Service in a manner consistent with any and all applicable laws and regulations.

f. Any automated use of the system, such as using scripts to add friends, is prohibited.

g. You may not sell or otherwise transfer your account.

7) Copyright Policy.
You may not post, distribute, or reproduce in any way, any copyrighted material, trademarks, or other proprietary information, without obtaining the prior written consent of the owner of such proprietary rights.

8) Disclaimers.
ALLCABOREALESTATE.COM is not responsible for any incorrect or inaccurate Content posted on the Website or in connection with the Service provided, whether caused by users of the Website, Members, or by any of the equipment or programming associated with or utilized by the Service. ALLCABOREALESTATE.COM is not responsible for the conduct, whether online or offline, of any user of the Website or Member of the Service. ALLCABOREALESTATE.COM assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, or unauthorized access to, or alteration of, any user or Member communication. ALLCABOREALESTATE.COM is not responsible for any technical malfunction or problems related to any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or player utilities due to technical problems or traffic congestion on the Internet or at any Website or combination thereof, including any injury or damage to users and/or Members or to any person's or organization's computer related to or resulting from participation or downloading materials in connection with the Website and/or in connection with the Service. Under no circumstances shall ALLCABOREALESTATE.COM be responsible for any loss or damage, including personal injury or death, resulting from use of the Website or the Service or from any Content posted on the Website or transmitted to Members, or any interactions between users of the Website, whether online or offline. The Website and the Service are provided "AS-IS" and ALLCABOREALESTATE.COM expressly disclaims any warranty of fitness for a particular purpose or non-infringement. ALLCABOREALESTATE.COM cannot guarantee and does not promise any specific results from use of the Website and/or the Service.

9) Limitation on Liability.
In no event shall ALLCABOREALESTATE.COM be liable to you or any third party for any indirect, consequential, exemplary, incidental, special or punitive damages, including lost profit damages arising from your use of the website or the service, even if ALLCABOREALESTATE.COM has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, ALLCABOREALESTATE.COM ´s liability to you from any cause whatsoever and regardless of from what action or in what form, will at all times be limited to the amount that you have paid to ALLCABOREALESTATE.COM for the service during your term of Membership as a member user.

10) Disputes.
If there is any dispute about or involving the Website and/or the Service, by using the Website, you agree that any dispute shall be governed by the laws of the area in which ALLCABOREALESTATE.COM is based, without regard to conflict of law provisions, and you agree to personal jurisdiction by and venue in the area in which ALLCABOREALESTATE.COM is based.

11) Indemnity.
You agree to indemnify and hold ALLCABOREALESTATE.COM , its subsidiaries, affiliates, officers, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorney's fees, made by any third party, due to or arising out of your use of the Service in violation of this Agreement and/or arising from a breach of this Agreement and/or any breach of your representations and warranties set forth above.

12) Refund policy.
If you sign-up for ALLCABOREALESTATE.COM services that require a fee, ALLCABOREALESTATE.COM will not refund any fee amount you have already paid us, even if you wish to terminate prior to the period under contract. However, if you have not failed any terms of use conditions and in the event that ALLCABOREALESTATE.COM requests early termination of your contract, ALLCABOREALESTATE.COM will refund the unused prorated amount versus the fee you already paid.

13) Other.
This Agreement is accepted upon your use of the Website and is further affirmed by you becoming a fee based Member of the Service. This Agreement constitutes the entire agreement between you and ALLCABOREALESTATE.COM regarding the use of the Website and/or the Service. The failure of ALLCABOREALESTATE.COM to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision. The section titles in this Agreement are provided for convenience only and have no legal or contractual effect. Please contact us with any questions regarding this Agreement. ALLCABOREALESTATE.COM is a division of MARKETING CABO.
